I. Introduction

These Terms and Conditions govern the contractual relationship between you, as the customer (whether a business or consumer), and ZiziCache, operated by Oleg Kolesnyk, with its registered at Konečná 902/19, 360 05 Karlovy Vary, Czech Republic, ID No. / IČ: 2633648, registered in the Trade Register (hereinafter the “Provider”).

II. Services Offered

We provide paid access to the premium WordPress plugin ZiziCache, which includes performance optimization tools (page caching, lazy loading, minification, etc.).

The plugin is provided under a fixed-term license (12 months).

We offer three license options:

• Single Site (1 domain)
• Multi Site (3 domains)
• Agency (25 domains)

III. Contract Formation

The order is placed by selecting a license, entering billing information, and confirming the order.

The contract is concluded at the moment the order confirmation is delivered by us.

By submitting the order, you also confirm your agreement with these Terms and Conditions.

IV. User Account

To use the plugin, you must have an account on our website.

You are obliged to keep your login credentials secure and to report any misuse to us.

V. Pricing and Payment

Prices are listed As-Is unless otherwise stated.

We accept payments through:

• Stripe, etc.

VI. Delivery of Digital Content

After payment is received, you will gain access to the license key and the plugin download link.

Each license key is valid for activation on the number of WordPress installations corresponding to the purchased license tier (1, 3, or 25 domains respectively). Use beyond this scope requires an upgraded license.

VII. Consumers and Right of Withdrawal

If you are a consumer within the meaning of Section 419 of the Civil Code, you have the right to withdraw from the contract without giving any reason within 14 days of its conclusion under Section 1829(1) of the Civil Code.

However, this right is forfeited if:

a) the digital content (plugin and license key) was made available with your explicit consent before the withdrawal period expired, and
b) you were duly informed that by giving this consent you would lose your right to withdraw (Section 1837(l) of the Civil Code).

Before submitting the order, you will be asked to check a box to indicate your consent to the loss of the right of withdrawal – without this consent, the plugin will not be made available.

VIII. Liability and Compatibility Limitations

ZiziCache is designed for WordPress 6+ and (optionally) WooCommerce 8+. Incompatibility with other plugins, themes or hosting environments may affect its functionality.

The user acknowledges that there is no guarantee of 100% functionality in all environments.

The Provider is not liable for damages caused by incompatibility, incorrect WordPress configuration, or other technical conditions.

These limitations apply to the maximum extent permitted by law but do not apply in cases of intentional misconduct or gross negligence (Section 2898 of the Civil Code).

IX. Support and Updates

During the license term, we provide:

• Email support (Mon–Fri, 10:00–15:00 CET)
• Access to plugin updates

Modifying the code of the plugin by the customer may void entitlement to technical support.

X. Governing Law and Dispute Resolution

The relationship between the Provider and the customer is governed by the laws of the Czech Republic.

For business customers, the competent court is the court at the Provider’s registered office.

Consumers have the option to resolve disputes out of court through the Czech Trade Inspection Authority (www.coi.cz) or via the online ODR platform: https://ec.europa.eu/consumers/odr

XI. Amendments to Terms and Conditions

We reserve the right to amend these Terms at any time. The new version will be published on the website and will become effective on the date stated in the terms.

The changes do not affect contracts already concluded.
